1. Creator Requirements
To sell on our marketplace, you must be the creator of the craft. You must have full rights to the craft and cannot resell items created by others. The seller must be the original creator of the product and resident in the United Kingdom to sell on Craft For Sale UK.
2. Product Listings
- Product Images: Craft pictures must showcase the actual product in high quality, without any frames, markers, or other modifications. Images should meet marketplace standards and be in JPG format.
- Product Descriptions: Provide an accurate and detailed description of your product.
- Free Gifts: Sellers cannot charge buyers for 'free gift' options.
- Handmade Products Only: We do not support drop-shipping or factory mass-produced products. Products should be handmade, handcrafted, designed or up-cycled by you to be sold with us. Items sold on Craft For Sale must not infringe someone else's copyright or trademark. It is your responsibility to check that you are not infringing Copyright or any Trademark (especially if you are using a brand name, logo, or character name).
- Any liability rests with you should the Copyright or trademark owner pursue a legal case against you for misuse of a trademarked term or logo and/or for using copyrighted material. Non-compliance will result in account suspension.
- External Links: Posting links to external websites in messages, questions, reviews, FAQ sections, or product descriptions is prohibited. You may provide social media links only in the "About You" section. Adult Products: Sellers must select the appropriate option when listing products for adults.
3. Verification and Compliance
Verification: We reserve the right to request proof of craft-making if there are strong suspicions or reports of mass production or reselling. Account Monitoring: Low reviews and frequent reports will trigger an investigation of your account. We will consider all sides before making a final decision. Non-compliance with our terms may lead to restrictions or suspension. Harassment: Any form of customer harassment will result in immediate account removal.
4. Payment Plans and Fees
- Payment Plan: Sellers accept a monthly fee for their chosen Payment Plan. Failure to pay will result in the automatic disabling of all crafts.
- Plan Changes: Sellers can downgrade or upgrade their Payment Plan at any time. To downgrade, remove any excess crafts before changing the plan.
- Bank Card Verification: Once verified, bank card details are locked to prevent unauthorised changes. To update bank details, apply through our re-verification system if necessary.
5. Orders and Transactions
- Transaction Status: Sellers should update the transaction status to inform buyers about progress.
- Shipping Responsibility: Sellers are responsible for shipping items within the stated handling time, using the delivery service selected by the buyer.
- Transaction Responsibility: Sellers are fully responsible for transactions and payments. The marketplace is not involved in the transaction or payment process.
- Feedback: Be open to feedback and respond positively. We will support you in resolving any strong, hurtful, or incorrect customer feedback.
6. Digital Products
- Hosting: Digital goods must be provided from your cloud service.
- Quality: Digital goods must be error-free and fully functional.
- Latest Versions: Sellers must provide buyers with the latest version of digital goods.
- Availability: Ordered files should be available for download for at least 24 hours.
- Rights Ownership: You must own the rights to digital goods. Infringements will be taken seriously.
- Accessibility: Ensure the digital product location is easily accessible to customers.
7. Early Access Sellers
- Reporting Issues: Beta sellers must report all found errors or issues via the report form (Feedback from Seller Dashboard).
- Confidentiality: Beta sellers cannot publish errors or issues on public forums or social media, both during and after the beta test. Violations result in permanent account blocking.
- Free Access: Beta sellers have free access to the marketplace during the beta test period.
- Activity Requirement: Early access sellers must list at least six crafts for sale and remain active on social media, promoting their own crafts on the CraftForSale marketplace, or the account will be disabled.
- Advertise: You allow CraftForSale to use photos of your crafts from your shop to promote both our marketplace and your unique creations. We’ll also feature your shop on our social media channels to boost visibility for both your business and ours (only for those purposes).
8. Legal Terms
- Responsibility: Sellers agree to prepare, create, and deliver crafts to buyers as described.
- Shipping Time: Sellers must ship crafts within the timeframe specified in the product description.
- Payment Gateways: Only business sellers have access to payment gateways such as Avalon, Stripe, etc.
- Account Removal: Sellers can remove their account at any time. The account will be removed after 30 days if there are no ongoing disputes.
- Contact Information: Sellers must provide a full address and bank account details and pay a startup fee to confirm bank account ownership.
9. Limitation of Liability
Craft For Sale, including its affiliates, partners, employees, or agents, shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the marketplace, including but not limited to any transactions conducted through the marketplace, any errors, omissions, interruptions, defects, delays, or computer viruses.
Craft For Sale does not guarantee uninterrupted or error-free access to the marketplace and disclaims liability for any issues arising from technical problems, including software bugs, server outages, or data loss.
10. Disclaimer of Warranties
The Marketplace and all services provided therein are offered on an "as-is" and "as available" basis. Craft For Sale makes no warranties or representations, either express or implied, regarding the accuracy, completeness, reliability, or availability of the marketplace, its content, or the goods and services sold by sellers. This includes any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
11. Intermediary Role
Craft For Sale acts solely as an intermediary platform to connect buyers and sellers and does not take part in any transaction between buyers and sellers. Craft For Sale does not endorse, guarantee, or verify the accuracy, quality, safety, legality, or availability of any goods or services listed by sellers. All transactions and interactions are the sole responsibility of the Buyer and Seller.
12. Indemnification
Sellers agree to indemnify, defend, and hold harmless Craft For Sale, its affiliates, officers, employees, agents, and licensors from any claim or demand, including reasonable attorney fees, arising out of or related to their use of the marketplace, their violation of these Terms, or their violation of any rights of another.
13. No Warranty for Technical Issues
Craft For Sale does not guarantee that the marketplace will operate without interruption or be free from errors. We are not liable for any loss or damage resulting from technical problems, including software bugs, server outages, or data loss.
14. Force Majeure
Craft For Sale shall not be liable for any failure to perform its obligations under these Terms and Conditions due to circumstances beyond its control, including, but not limited to, acts of God, natural disasters, cyber-attacks, governmental actions, or any other events of force majeure.
15. Amendments to the Terms and Conditions
We reserve the right to modify these terms at any time. Continued use of the marketplace after such changes constitutes acceptance of the new terms. It is the responsibility of the user to review these Terms periodically.
16. Governing Law
These Terms and Conditions are governed by the laws of the United Kingdom.
17. Miscellaneous
If any part of these Terms is held to be invalid or unenforceable, the remainder of the Terms will still apply. Failure by Craft For Sale to enforce any right or provision of these Terms will not be considered a waiver of those rights.
